Saratoga County LLC Publication

Complete Saratoga County LLC Publication for $349 — Two Newspapers, Six Weeks, Affidavits and State Filing Included.

If your New York LLC's formation filing identifies Saratoga County as its office county, you generally must complete New York's newspaper publication requirement. That means arranging a notice in a county-designated daily newspaper and weekly newspaper for six consecutive weeks, collecting both affidavits and filing the Certificate of Publication with New York State.

Saratoga County LLC publication is comparatively straightforward when the correct newspaper designations are used. The Saratoga County Clerk publicly identifies four daily newspapers and two weekly publications for LLC notices. We coordinate the required daily-and-weekly pair, run the notices for six consecutive weeks and file the Certificate of Publication with New York State for a flat $349.

Our $349 standard Saratoga County service includes notice drafting, designated newspaper coordination, both six-week advertisement runs, the two Affidavits of Publication, Certificate of Publication preparation, the $50 state filing fee, filing coordination and digital completion records. There is no additional expedite fee.

What New York LLC Publication Actually Requires

Under New York Limited Liability Company Law § 206, most newly formed domestic LLCs must publish a copy of their Articles of Organization or an authorized notice containing the required information. The notice runs once a week for six consecutive weeks in two newspapers, one printed daily and one printed weekly, designated by the county clerk for the LLC’s county of office. The LLC must then file a Certificate of Publication with both newspaper affidavits at the New York Department of State.

The requirement is about the county specified in the LLC’s official filing, not necessarily where the member lives, where customers reside, where a mailing address is located, or where a commercial registered agent has offices. Check your Articles of Organization before deciding which newspaper market to use. If you need to correct your county designation, review our guide to changing an LLC county before publication before purchasing advertising.

The legal deadline is generally 120 days after the domestic LLC’s Articles of Organization become effective. For foreign LLCs authorized to conduct business in New York, the comparable publication rule is contained in LLC Law § 802, and the 120-day period generally begins after the Application for Authority is filed. Ordinary newspaper publication is a post-formation compliance step, not the document that originally creates an LLC.

What you receive when publication is complete

The two newspapers provide signed Affidavits of Publication after the six-week run. The completed Certificate of Publication, with both affidavits attached, is then submitted to the Department of State with its $50 filing fee. Your records should include both affidavits and the filing confirmation. For a fuller explanation of each document, read what a New York Certificate of Publication does.

Saratoga County LLC Publication Newspapers: Four Daily, Two Weekly

Saratoga County’s official list is especially clear. It designates four daily newspapers and two weekly newspapers for LLC notices. An LLC must use one qualifying paper from each category, following the current County Clerk requirements.

Official Saratoga County daily newspapers

Daily newspaper Regional identity
The Saratogian Saratoga Springs area
Times Union Albany and the Capital Region
The Daily Gazette Schenectady and surrounding Capital Region
The Post-Star Glens Falls and the southern Adirondack area

Official Saratoga County weekly newspapers

Weekly newspaper Regional identity
The Express Mechanicville area
Saratoga TODAY Saratoga Springs and Saratoga County readership

These are the publications named on the county’s official LLC Publications page. An official county PDF dated December 3, 2025 also identifies the same titles. Newspaper contacts and designations can change, so verify the page before placing any advertisement independently.

Why are some daily newspapers based outside Saratoga County?

The geographic location of a publisher’s office is not the sole qualification. For example, the county lists the Times Union, The Daily Gazette and The Post-Star alongside The Saratogian. The controlling factor is that the Saratoga County Clerk designated the newspaper for the LLC notice, not whether every publisher is headquartered in Ballston Spa.

Does the weekly paper have to serve my town?

The published list has two weekly titles. Whether you operate in Mechanicville, Malta, Clifton Park or Saratoga Springs, confirm eligibility and placement with the publishers in accordance with the Clerk’s current designations. The publication process does not require you to run separate notices for every town in which the company has customers.

How Much Does Saratoga County LLC Publication Cost?

LLC Publication Online’s standard Saratoga County price is $349, all-inclusive. That includes both newspaper placements for six successive weeks, notice preparation, collection of publisher affidavits, preparation and filing of the Certificate of Publication, and New York’s $50 state fee.

Included component In the $349 package?
Designated daily newspaper Yes
Designated weekly newspaper Yes
Six successive weekly notices in each Yes
Legal notice drafting Yes
Two publisher affidavits Yes
Department of State Certificate of Publication Yes
$50 state filing fee Yes
Digital completion documentation Yes
Extra expedite charge No

Unlike a $50 government filing, newspaper advertisements do not have one price throughout New York. Your $349 is a private service price, not the amount charged by the Saratoga County Clerk to designate newspapers. The cost of DIY publication will vary depending on the authorized newspapers’ quotes and notice length.

Saratoga versus Albany County LLC publication costs

Both are in the Capital Region and LLC Publication Online currently lists $349 for each county’s standard publication service. That does not make their newspaper designations interchangeable. If your Articles name Saratoga County, publish under Saratoga County requirements. If they name Albany County, read our Albany County LLC publication guide. The price coincidence does not change the legal county.

Saratoga Springs, Clifton Park, Malta and Ballston Spa LLCs

Saratoga County combines visitor-driven businesses, growing suburban commercial districts, local professional firms and companies operating across the Capital Region. Each needs to follow the same county-based publication rule if Saratoga County is the office county named in the LLC filing.

Saratoga Springs LLC publication

Restaurants, retail shops, hospitality providers, consultants and property LLCs commonly associate themselves with Saratoga Springs. The city also has a locally familiar daily paper, The Saratogian, and a designated weekly, Saratoga TODAY. Those names help explain the local newspaper landscape, but the legal requirement remains a properly designated daily-and-weekly pair with six successive weeks in each.

Clifton Park, Halfmoon and Mechanicville

Southern Saratoga businesses are often close to Albany and Schenectady counties. That proximity does not by itself shift the publication county. If the filed office county is Saratoga, you must use Saratoga County’s designated newspapers. The Clerk’s weekly list includes The Express, associated with Mechanicville, but advertisers should confirm the current schedule and approval before booking.

Malta and Round Lake

Malta-area technology businesses, service companies, consultants and property LLCs may operate across several municipalities. The location of a warehouse, retail site or customer is not a substitute for checking the filed office county. An LLC that lists Saratoga County is subject to the Saratoga publication procedure even if its owner lives in Albany County.

Ballston Spa and Ballston Lake

Ballston Spa is the Saratoga County seat and home to the County Clerk’s office at 40 McMaster Street. You do not need to publish in Ballston Spa specifically. The clerk designates newspapers for the county, and publication is ultimately completed through New York State filing after the newspaper affidavits are received.

Wilton, Greenfield and Corinth

Companies in northern Saratoga County may be closer to Adirondack and Glens Falls media markets. The County Clerk’s published list includes The Post-Star as a daily option, reflecting the wider regional newspaper environment. Using a nearby newspaper that is not on the designated list, however, would still be a risk.

Waterford, Stillwater and Schuylerville

Commercial, residential property, contracting and home-based LLCs in these communities generally follow Saratoga County publication requirements if the company’s Articles of Organization identify Saratoga County. You do not need to maintain a storefront to trigger the standard legal publication rule.

Saratoga LLC Publication Timeline

The most predictable part is the six successive weekly newspaper issues. The first issue depends on the two newspapers’ placement deadlines. The affidavits normally follow the final issue, and the Department of State filing occurs afterward.

Stage Saratoga County consideration
Formation check Confirm effective date and Saratoga County in the accepted filing
Newspaper pair Choose from Clerk-designated daily and weekly categories
First issues Based on the newspapers’ legal advertising cutoffs
Legal run Six successive weeks in both publications
Proof Obtain Affidavit of Publication from each paper
Final compliance File Certificate of Publication and affidavits with NY DOS

Plan approximately seven to nine weeks for the complete workflow, while recognizing that schedules and processing vary. No publication provider can lawfully reduce the six-week requirement to a one-week announcement simply by charging for expedited service.

Where Does the Saratoga County Clerk Fit In?

The Saratoga County Clerk supplies official newspaper designations. It does not replace the Department of State for final LLC compliance filing.

Saratoga County Clerk: 40 McMaster Street, Ballston Spa, NY 12020; telephone (518) 885-2213. The most useful public reference is its LLC Publications webpage, which shows the authorized daily and weekly choices. Review this page rather than an undated newspaper directory or an old online forum answer.

Saratoga vs. Schenectady, Albany and Warren Counties

Saratoga County crosses several business corridors in the Capital Region. It is easy to operate across county lines, but the statutory publication county remains the one properly designated in the LLC’s filing.

Situation How to think about publication
Saratoga County listed in Articles Follow Saratoga Clerk-designated newspaper requirements
Albany County listed in Articles Follow Albany County designations; see Albany guide
Business serves Schenectady clients Client location does not automatically change the office county
LLC owns property near Glens Falls Confirm which county is designated in the LLC filing
Out-of-state LLC authorized in NY Use county in NY Application for Authority, not home state

If your LLC operates from multiple places or you are considering correcting its designated county before publication, read our county-change guide before placing notices.

Common Saratoga LLC Publication Errors

Running a notice only in The Saratogian

A designated daily is just half of the required pair. Publication must also run for six successive weeks in a designated weekly paper.

Choosing a newspaper solely because it serves Saratoga Springs

A title can be local without having the current legal designation. The current County Clerk list, not general brand recognition, controls eligibility.

Assuming the County Clerk files the Certificate of Publication

The Clerk provides newspaper designations. The completed Certificate of Publication and affidavits are filed with the New York Department of State in Albany.

Treating the low county price as permission to relocate publication

Saratoga’s $349 service price is attractive, but an LLC whose official office county is Manhattan or Queens may not use Saratoga papers solely to save money. A genuine change to filed information is a separate legal and administrative decision.

How the Six-Week LLC Publication Process Works

1. Review the state formation or authorization filing

Check the company’s exact legal name, New York filing date, designated county, street address of the principal business location if any, mailing address for legal process, registered agent information if applicable, and any other statements required by law. A foreign LLC should also identify its home jurisdiction, original formation date, and the name under which it is authorized in New York. Accuracy at this stage helps avoid paying to run a corrected notice later.

2. Obtain the correct county newspaper designations

The clerk’s rules and newspaper lists vary considerably from county to county. The publication must use an authorized daily newspaper and an authorized weekly newspaper. The designated pair is not interchangeable with an arbitrary local blog, online directory or free community listing. We handle newspaper coordination as part of the service.

The notice uses the LLC’s formation or authorization information, not general promotional copy. Newspaper deadlines are based on actual print schedules; a placement may begin in the next available issue rather than the same day an order is submitted. Publishing the same notice online, or publishing once in one newspaper, does not replace six successive weekly publications in both qualified papers.

4. Complete the required six consecutive weeks

Each newspaper publishes the notice once a week for six successive weeks. The start dates can differ. Track the dates for each publication separately, and do not count a proposed date as a completed advertisement until the newspaper confirms placement.

5. Obtain affidavits from both publishers

The publisher’s Affidavit of Publication identifies the notice and confirms when it ran. Both affidavits are required for the standard Certificate of Publication filing. A screenshot of the advertisement or an invoice alone is not a substitute for the required affidavits.

6. File the Certificate of Publication with New York State

After the affidavits arrive, prepare the appropriate domestic or foreign Certificate of Publication and file it with the New York Department of State, Division of Corporations, at One Commerce Plaza, 99 Washington Avenue, Albany, NY 12231. The state filing fee is $50 and is included in our advertised service price. Once the state accepts the filing, keep the paperwork with the LLC’s permanent business records.

The 120-Day Deadline, Late Publication, and Compliance

The six-week advertising period is fixed by state law. Because preparation, newspaper scheduling, affidavit delivery and state processing add time, the safest approach is to start soon after formation or authorization rather than waiting until the last month of the deadline. Our practical planning range for the full process is often seven to nine weeks, although actual turnaround may be shorter or longer depending on the newspapers and the Department of State.

What happens if you miss 120 days?

For an LLC subject to the publication rule, failing to complete publication and file the required proof within the statutory period causes a suspension of authority to carry on, conduct or transact business in New York. This is serious, but the statute does not say that the LLC automatically dissolves or that existing contracts become void solely because the deadline was missed. The law preserves specified contractual rights and obligations.

Can an overdue LLC still publish?

Yes. An LLC that missed its publication deadline can generally correct the issue by publishing in the proper newspapers and filing a Certificate of Publication with both affidavits. The statutory suspension is annulled upon a substantially compliant filing. If the business has been operating for a long time or faces a transaction, litigation or licensing question, consult a New York attorney about the legal implications of its particular situation. We explain the issue further in what happens if you never publish your LLC.

Can the six-week period be expedited?

The law does not provide a paid shortcut to compress the six successive weeks. A service can act promptly to arrange advertisements and handle affidavits without an extra rush fee, but it cannot transform six weeks of legally required newspaper notices into one or two weeks.

Domestic LLC Publication Notice Example for Saratoga County

A notice should contain the substance of the Articles of Organization and the information required under § 206. The following example uses a fictional company name and placeholders so you can see the general format without mistaking it for a final legal notice.

NOTICE OF FORMATION OF LIMITED LIABILITY COMPANY. Notice of Formation of [Example Business LLC]. Articles of Organization filed with the Secretary of State of New York (SSNY) on [Filing Date]. Office location: Saratoga County. Principal business street address, if any: [Street Address]. SSNY designated as agent of the LLC upon whom process against it may be served; SSNY shall mail process to [Complete Mailing Address]. Purpose: Any lawful purpose.

The correct notice also needs to reflect any distinct effective date, registered agent information, specific dissolution date and other applicable items under the statute. Do not replace the SSNY service-of-process address with a guess or use an owner’s residence merely because it seems convenient. Compare every fact with the accepted state filing. For more examples, see our NY LLC publication notice wording guide.

Foreign LLC Publication in Saratoga County

A foreign LLC is an LLC formed outside New York that applies for authority to do business in the state. For example, a Delaware, Connecticut, Florida or New Jersey LLC may become subject to New York publication rules after filing its Application for Authority. The relevant publication county is the county specified for the New York office in that application; the home state does not select the newspapers.

Foreign LLC notices are more detailed than ordinary domestic formation notices. They generally include the authorized New York name, filing date of the Application for Authority, original formation jurisdiction and date, New York office county, process mailing address, the address of the required or principal office in the formation jurisdiction, and the identification of the foreign jurisdiction’s filing authority. If the original legal name differs from the name authorized in New York, the text should account for both accurately. Additional information can be needed depending on the filing.

The foreign LLC publication requirements guide covers those differences. The publication duty for most foreign LLCs appears in New York LLC Law § 802; its 120-day deadline is generally tied to filing the New York Application for Authority, not the date the business first formed elsewhere.

Example: foreign LLC notice in Saratoga County

NOTICE OF APPLICATION FOR AUTHORITY OF FOREIGN LLC. Application for Authority of [Authorized New York LLC Name], a foreign limited liability company, filed with the Secretary of State of New York (SSNY) on [NY Filing Date]. LLC formed in [State or Jurisdiction] on [Original Formation Date]. Office location: Saratoga County. Principal business location, if any: [Street Address]. SSNY designated as agent for service of process; SSNY shall mail process to [Complete Mailing Address]. Office required to be maintained in formation jurisdiction, or principal office if none required: [Full Address]. Organizational document filed with [Name and Address of Home Jurisdiction Filing Authority]. Purpose: Any lawful purpose.

This is a simplified educational sample, not a ready-to-submit notice. It assumes that the authorized New York name matches the original legal name, the filing is publicly maintained in the formation jurisdiction, and no extra registered-agent or other clauses apply. Actual foreign LLC notices must be drafted from the precise Application for Authority and the requirements of § 802.

Saratoga County LLC Publication FAQs

How much does LLC publication cost in Saratoga County?

LLC Publication Online lists a $349 all-inclusive Saratoga County standard service, including newspaper advertising, notice preparation, two affidavits and the $50 New York State Certificate of Publication filing fee.

Is LLC publication mandatory in Saratoga County?

Generally yes for domestic LLCs with Saratoga County designated as their office county, and for applicable foreign LLCs authorized in New York. The standard process requires two qualifying newspapers.

Which daily newspapers does Saratoga County designate?

The Saratoga County Clerk’s published LLC list names The Saratogian, Times Union, The Daily Gazette and The Post-Star as daily newspapers.

Which weekly newspapers are designated in Saratoga County?

The Clerk names The Express and Saratoga TODAY as weekly newspapers for LLC publication. Review the official county list before booking a legal notice.

Can I publish only in The Saratogian?

No. A single daily newspaper is insufficient. New York law requires one daily and one weekly newspaper, both properly designated, for six consecutive weeks.

Does Saratoga TODAY qualify as a weekly paper?

Saratoga TODAY appears on the Saratoga County Clerk’s published list of designated weekly newspapers for LLC notices.

Can I use the Times Union for Saratoga County LLC publication?

The Times Union appears on the Saratoga County Clerk’s designated daily newspaper list. You also need a qualifying weekly paper and must verify current requirements.

Does an LLC in Clifton Park publish in Albany County?

Not solely because Clifton Park is near Albany County. Saratoga County is the publication county when it is the county properly designated on the LLC filing.

Does a Saratoga Springs LLC need a newspaper based in Saratoga Springs?

Not necessarily. The County Clerk lists qualifying daily publications from several regional markets. The actual newspaper designation matters more than where a publisher maintains its office.

How long does Saratoga LLC publication take?

Each of the two newspapers must publish the notice once weekly for six successive weeks. The total process often takes around seven to nine weeks when scheduling, affidavits and state filing are included.

What is the publication deadline for a new Saratoga LLC?

For most domestic LLCs, publication and filing must be completed within 120 days after the Articles of Organization become effective.

Can a Saratoga County LLC publish late?

Yes. A late LLC can usually complete the newspaper run and file the Certificate of Publication with both affidavits; a substantially compliant filing annuls the statutory suspension.

Does an out-of-state LLC need publication in Saratoga County?

Generally yes if it is a foreign LLC authorized in New York with Saratoga County specified as its New York office county. The governing statute is LLC Law § 802.

Is publication required for single-member LLCs in Saratoga County?

Generally yes. There is no blanket exemption from the state LLC publication requirement solely because an LLC has one member.

Do Saratoga real estate holding companies need publication?

Generally yes if they are LLCs subject to the statute. An LLC formed to own property is not automatically exempt from the publication obligation.

Where is the Saratoga County Clerk office?

The Clerk lists 40 McMaster Street, Ballston Spa, NY 12020, and telephone (518) 885-2213.

Where do I file the completed Saratoga Certificate of Publication?

File it with the New York Department of State in Albany, with both publisher affidavits and the $50 filing fee. It is not filed as a replacement at the Saratoga County Clerk’s office.

Can I choose newspapers just because they charge less?

You can compare pricing among eligible options, but the publications must be among those appropriately designated by the Saratoga County Clerk. An unauthorized cheaper newspaper will not solve the compliance requirement.

Can I shorten the six-week period if my deadline is near?

No. The statute requires six successive weekly notices in each newspaper. Faster administration cannot lawfully replace the required publication run.

Do I need to republish every year?

No. The formation or foreign-authorization publication is generally a one-time compliance step rather than an annual advertising obligation.
